Twenty-three thousand Americans a year
are killed by dangerous products,
with 31 million being injured.
Some of the top products
that cause injury are bicycles, toys,
power equipment, baby strollers.
Hundreds of everyday products
are recalled each year.
Over the 30 years
that I've been in practice,
I've handled hundreds
of dangerous product cases.
That includes exploding products
such as lithium-ion batteries
and computers and hoverboards,
bikes that have their frames
improperly welded
that have broken apart,
numerous toys that have small pieces
that break off that children ingest.
We've also handled a number
of dangerous vehicle cases.
Those cases are very sophisticated
and very expensive to pursue.
Another major area
in which we see defective products
is in the area of appliances.
Other product liability cases
we've been involved in
have been improperly stored
and labeled chemicals,
food products where there might be glass
and other contaminants, power equipment.
We've seen a number of cases
where you've had chairs fail,
and a lot where there
have been ladders that have collapsed.
The legal standard
in product liability cases
is that you have to show that there
is a defect that makes the product unsafe.
Now, as we all know, there's been
a tremendous shift to online sales.
Until a couple of years ago,
these online retailers
weren't held responsible
for the damages
that their products caused.
That's until I took a case
called Loomis versus Amazon,
where I brought the case on behalf
of a woman who had a hoverboard
explode in her house on Christmas Day.
The manufacturer was located in China,
and went out of business.
The distributor had gone out of business.
The only person left in the chain
of distribution was Amazon.
Amazon said,
"We don't sell products.
We're just like a classified advertiser."
Well, I didn't fall for that.
I brought the case,
and we lost it at the trial court level,
which I was fine with because I knew
then we'd get to the Court of Appeals.
In the Court of Appeals
for the first time in the United States,
and the first time in California,
Amazon was deemed to be a retailer
and could be held responsible
for the products that it sold
over the internet.
That's because
they're in the best position
to make sure the products
they're selling are safe.
My firm has recovered
tens of millions of dollars
for people who've been injured
by defective products.
