Under California Government Code,
Section 12947.5,
is unlawful to demand
that a woman must wear a dress
and to refuse her request to wear pants.
This law is designed
to eliminate gender stereotypes.
The law does not prohibit
the wearing of a uniform
or a dress as part of a costume,
think Disney Princess.
Employee who has been
disciplined, terminated,
or has suffered
an adverse employment action
because of their refusal to wear a dress,
they've lost a position,
they've been demoted or terminated,
has a right to bring
a legal action for damages.
That can include back pay, front pay,
as well as non-economic damages
such as emotional distress, fear,
anxiety, humiliation.
