In this country,
we give tremendous power to the police.
They have the right to bear arms,
the right to stop, detain, arrest,
and to use force, up to lethal force,
to try to accomplish their jobs.
The right to be free from unnecessary
abuse comes through our United States
Constitution under the Fourth Amendment.
The Fourth Amendment protects citizens
from excessive force by law enforcement.
When trying to determine
if the force was excessive,
a judge or a jury will be asked
to consider whether the officer reasonably
believed the force
was necessary to protect themselves
or to achieve their objective.
The law pertaining
to police abuse and excessive force
is what we refer
to as 42 United States Code, Section 1983.
It is the deprivation
of rights under color of law,
meaning that a law enforcement
person or a correctional guard
has deprived someone
of their fourth Amendment right to be free
from the use of excessive force.
When there's a claim
of an excessive use of force,
the police will often try and justify
it through charges of resisting arrest,
claiming that someone had a weapon,
or claiming that they were
in fear of their own personal safety.
A lot of these charges are just
trumped-up charges to try to justify
an excessive reaction by the police.
My firm has handled
a number of police abuse cases
and tried them to a jury verdict,
including shootings,
beating, police dog attacks,
the improper use of tasers, excessive use
during crowd control at peaceful protests.
We had a case where a police horse
in crowd control crushed a man
out at Old Candlestick Park.
A person who suffered
excessive force and police abuse
has the right to have their
case heard in front of a jury.
Someone who's experienced
an excessive use of force,
whether it's a beating
or the loss of a loved one
they're entitled to recover damages
from the state
or local government who's responsible.
That includes
pain and suffering, emotional distress,
fear, anxiety, humiliation.
Many people that we've helped who've had
police abuse cases have a tremendous fear
