Aimee Kirby is an accomplished civil litigator with a robust 23-year career inspired by a book she read as a child about the pioneering work of Sandra Day O'Connor and the firsthand experience of watching her own mother, Margaret L. Kirby, also an attorney, argue in court.

Kirby's legal acumen has also been shaped by the guidance of some of California's most esteemed women in civil litigation, including Christine Spagnoli, Amy Solomon and Genie Harrison, who have taught her to adeptly navigate complex litigation, lead with conviction, and courageously speak her mind.

Nowadays, Kirby's caseload includes a broad array of matters, ranging from child abuse to personal injury, employment discrimination and harassment, pregnancy, disability and medical leave, dangerous condition and government tort liability and whistleblower lawsuits.

Kirby described 2024 as a milestone for her career, marked by her involvement in several challenging cases that she personally brought into the firm.

One matter involved an alleged dangerous condition on a roadway near Livermore centering around an improperly marked curve. Fuller et al. v. County of Alameda, et al., 22CV013312 (Ala.Sup. Ct., filed June 23, 2022).

"On the day of the accident, five teenage boys were in the vehicle when they hit the curve and tumbled off the roadway," Kirby explained. "One teenage boy died, my two clients were critically injured, and two passengers suffered minor injuries. Despite allegations of excessive speed, the driver violating his provisional license and consuming alcohol, the case resolved for over $3.6 million dollars against [Alameda] County."

Kirby said these cases involved complex liability and injuries, which requires thinking about what will be needed at trials, which are two years away from when they are signed up, and starting to build the story you will need to have airtight to either resolve or try these matters against formable opponents.

"My best analogy of high-level plaintiff's work is that it is our job to blow up the world's best ballon for our clients, and it is the defenses job to simply prick our perfect ballon enough that it collapses," Kirby said.
