Under California Government Code, Section 12947.5, is unlawful to demand that a woman must wear a dress and to refuse her request to wear pants. This law is designed to eliminate gender stereotypes. The law does not prohibit the wearing of a uniform or a dress as part of a costume, think Disney Princess. Employee who has been disciplined, terminated, or has suffered an adverse employment action because of their refusal to wear a dress, they've lost a position, they've been demoted or terminated, has a right to bring a legal action for damages. That can include back pay, front pay, as well as non-economic damages such as emotional distress, fear, anxiety, humiliation. It's hard to believe that this still happens today, but it does. If it's happened to you or someone you know, have them contact us here at the Dolan Law Firm, dolanlawfirm.com.
