A 50-year-old Vallejo man died after being struck by a vehicle on eastbound Interstate 80 near Tennessee Street in Vallejo following a reported dispute during a Lyft ride. According to CBS San Francisco, the incident happened early Saturday morning after a Lyft driver stopped on the shoulder and called authorities to report that his passenger had allegedly verbally and physically assaulted him.

The California Highway Patrol reportedly said the Lyft driver, a man in his 30s from Sacramento, exited the vehicle after stopping on the freeway shoulder. The passenger then allegedly followed and chased the driver along the shoulder toward Redwood Parkway. Shortly before 1:20 a.m., the passenger was struck in the right lane by a black Audi sedan.

CBS San Francisco reported that the Audi driver told CHP she did not see the pedestrian until it was too late. The Lyft driver reportedly told authorities he had picked up the passenger from a bar in Benicia and was taking him home to Vallejo. According to the report, the driver also said the passenger appeared to be highly intoxicated.

The fatal incident raises serious questions about rideshare safety, freeway pedestrian crashes, intoxicated passengers, and how liability may be evaluated when a rideshare trip turns dangerous. Generally, in California, rideshare services such as Uber or Lyft are considered common carriers. Being a common carrier requires the service to use a heightened duty of care. Under California Civil Code section 2100, a carrier of persons for reward must use the “utmost care and diligence.” Importantly, that duty can extend to the places where passengers are picked up or dropped off. In a case like this one, where the passenger ended up outside the vehicle on the freeway, investigating whether he was let out of the vehicle, was advised to stay inside, or exited on his own is very important in establishing the potential liability of the rideshare driver and rideshare company.”
